Gentlemen and/or Ladies:

Having examined the bidding documents including all the agenda thereof, the receipt of which is hereby duly acknowledged, we, the undersigned, offer to supply and deliver Package No. 4: Dead-Burned Magnesite under the BID NAM No. CMC 991208 in conformity with the said bidding documents for the sum of Ex-work USD 5,000,000.00 that is to say Ex-work US Dollar FIVE MILLION only and price of incidental services specified in the Technical Specifications (such as factory inspection and domestic training, etc.) FREE OF CHARGE, or such other sums as may be ascertained in accordance with the Schedule of Prices attached herewith and made part of this bid.

We undertake, if our bid is accepted, to deliver the goods in accordance with the delivery schedule specified in the Schedule of Requirements.

If our bid is accepted, we will obtain the guarantee of a bank in a sum equivalent to twelve percent of the contract price for the due performance of the contract, in the form prescribed by the purchaser.

We agree to abide by this bid for a period of 120 days from the date fixed for bid opening under Clause 22 of the Instructions to Bidders, and it shall remain binding upon us and may be accepted at any time before the expiration of that period.

Pursuant to NAM Clause 2, we declare that, we are not associated, or have been associated in the past, with a firm or any its affiliates which have been engaged by the purchaser to provide consulting services for this project, and we are not a dependent agency of the purchaser.

Until a formal contract is prepared and executed, this bid, together with your written asseptance thereof and your notification of ward, shall constitute a binding contract between us. Commissions or gratuities, if any, paid or to be paid by us to agents relating to this bid, and to contract execution if we are awarded the contract, are listed below: Name & address of agent; Amount & currency.

We understand that you are not bound to accept the lowest or any Bid you may receive.
